1. About These Terms

These Terms of Use (“Terms”) govern your use of the website quantumcorecreative.com (the “Site”) and the services provided by João Ferreira trading as Quantum Core Creative (“QCC”, “we”, “us”, “our”), registered business name no. 2. Our Services

QCC provides digital marketing, IT support, website design and development, and related services to businesses (“Client”, “you”). The specific scope of any engagement will be set out separately in a quote, proposal, or written agreement between QCC and the Client.

3. Quotes and Estimates

• All prices, quotes, and estimates provided by QCC — whether on this Site, by email, or verbally — are estimates only and are not binding until confirmed in writing.
• Final project costs may vary from an initial estimate where the scope of work changes, additional features or revisions are requested, or unforeseen technical issues arise during the project.
• Any change to the agreed scope of work may result in a revised quote, which will be communicated to the Client before additional work proceeds.
• Quotes are valid for 30 days from the date issued unless otherwise stated.

4. Payment Terms

• Payment terms will be set out in the relevant invoice or agreement for each project.
• Unless otherwise agreed in writing, a deposit may be required before work begins, with the balance due upon completion or per an agreed payment schedule.
• Late payments may result in a pause of ongoing work or services until outstanding invoices are settled.

5. Ownership of Work and Intellectual Property

• Until full and final payment has been received, all designs, code, content, and other deliverables created by QCC in connection with a project remain the intellectual property of QCC.
• Upon receipt of full payment upon cleared funds, ownership of the final, agreed deliverables (e.g., the completed website, final designs, custom code developed specifically for the Client) transfers to the Client, except where third-party assets (such as licensed stock images, fonts, plugins, or themes) are used — these remain subject to their own respective licences.
• QCC retains the right to showcase completed work in its own portfolio, marketing materials, and case studies, unless the Client requests otherwise in writing.
• Any pre-existing tools, frameworks, templates, or proprietary systems used by QCC to deliver a project remain the property of QCC and are not transferred to the Client.

6. Client Responsibilities

• The Client is responsible for providing timely feedback, content, access credentials, and approvals required for QCC to complete the agreed work.
• Delays caused by the Client (e.g., late feedback, missing content) may affect project timelines and are not the responsibility of QCC.
• The Client is responsible for the accuracy and legality of any content, images, or materials they provide to QCC for use in a project.

7. Limitation of Liability

• QCC will carry out services with reasonable skill and care, but does not guarantee specific results (such as search engine rankings, social media growth, sales figures, or lead volume), as these depend on factors outside our control.
• QCC is not liable for any loss, damage, or disruption arising from:
  
  • Changes to third-party platforms, algorithms, or policies (including but not limited to Google, Meta, TikTok, or other search engines and social media platforms)
  • Server downtime, hosting provider issues, or outages caused by third-party hosting or infrastructure providers
  • Actions taken by the Client or third parties on systems, websites, or accounts after project completion or handover
  • Force majeure events outside QCC’s reasonable control
• To the fullest extent permitted by law, QCC’s total liability for any claim arising from its services shall not exceed the total amount paid by the Client for the specific service giving rise to the claim.
• Nothing in these Terms limits or excludes liability that cannot be limited or excluded under Irish law (e.g., liability for death, personal injury caused by negligence, or fraud).

8. Confidentiality

QCC will treat any confidential business information shared by the Client during the course of a project as confidential, and will not disclose it to third parties except as required to deliver the agreed services or as required by law.

9. Cancellation and Refunds

• Either party may terminate an ongoing engagement with 30 days written notice, unless otherwise specified in a separate agreement.
• Any work completed up to the point of cancellation will be invoiced and payable by the Client.
• Deposits are generally non-refundable once work has commenced, except where QCC is unable to deliver the agreed services.

• The content on this Site is provided for general information purposes only and does not constitute professional advice.
• QCC reserves the right to update, amend, or remove content from this Site at any time without notice.
• You may not copy, reproduce, or reuse content from this Site without prior written permission.
